1. Our Agreement With You
These Terms & Conditions apply to all bookings, training, mentorship, services, product sales, and media produced or facilitated by Flying Karlis, SIA (Reg. No. 40203558447), hereafter referred to as “we,” “us,” or “Flying Karlis.” The participant, customer, or user is referred to as “you.”
2. Assumption of Risk, Liability & Indemnity
High-Risk Activity: Paragliding, SIV training and all related activities are inherently dangerous and carry a risk of serious personal injury or death. Voluntary Participation: You acknowledge you fully understand these risks. You agree to participate voluntarily and assume all responsibility for these risks. Liability Waiver: You release Flying Karlis (including all staff, instructors, agents, landowners, and equipment providers) from all liability for personal injury, death, or property loss arising from your participation. This waiver applies unless the incident is caused by our proven gross negligence or willful misconduct. Indemnity: You agree to indemnify and hold harmless Flying Karlis from any claims, damages, or expenses made by a third party that arise from your actions during your participation.
Duration: Your obligations under this section remain in full effect after the activity is completed and are binding on your heirs and legal successors.
3. Your Health & Fitness to Participate
Medical Disclosure: You must inform us of any medical or physical conditions (e.g., heart conditions, epilepsy, high blood pressure, diabetes) that could affect your ability to participate safely. Medical Clearance: We reserve the right to request a medical certificate or refuse participation if we have concerns about your health or safety. Alcohol & Drugs: Consumption of alcohol or performance-impairing drugs is strictly prohibited for at least 10 hours before any training or flight activity.
4. Instructor Authority & Your Conduct
Instructor Authority: The safety decisions made by Flying Karlis instructors are final and absolute. Non-compliance with instructions may result in immediate removal from the activity without a refund. Participant Conduct: You must follow all safety rules and act respectfully toward staff, other participants, and facilities.
5. Payments & Cancellations
Payment: Full payment is made upon booking of the course.
Cancellation by You: No refund. Travel insurance is highly recommended and should cover these expenses in unforeseen circumstances. Participants who cancel their course less than 12 weeks before the start of the course and want to rebook will have to pay a €250 rebooking fee. No rebooking 8 weeks prior to the course date.
Cancellation by Us: Flying Karlis reserve the right to cancel a course at any time. If this happens, we will offer you an alternative date at no extra charge. Flying Karlis is not liable for any other costs you may have incurred, such as travel, accommodation, or insurance.
6. Weather Policy
Paragliding is a weather-dependent sport. Safety is always our first priority, and flying days cannot be guaranteed. By booking a course with us, you agree to the following conditions:
1. Course Structure
Each course fee includes two parts:
- Pre-course online training platform (theory and knowledge base, delivered immediately upon booking).
- Practical on-site flying instruction.
2. Non-Refundable Portion (60%)
Upon payment, participants receive access to our exclusive pre-course learning platform. In addition, the school incurs fixed costs related to logistics, team travel, and accommodation. For this reason, 60% of the course fee is considered non-refundable once booking is confirmed.
3. Weather-Dependent Portion (40%)
If weather prevents the completion of the practical flying sessions, a credit of up to 40% of the course fee will be issued, depending on the proportion of the practical training completed. This credit can be applied toward a future course within 12 months. When re-booking, the participant will pay the difference between the new course fee and the credited amount. Credits are individual and cannot be transferred or combined to cover a full future course.
7. Mandatory Insurance
You must hold valid personal accident, health, and travel insurance for the entire duration of your activity with us. Your policy must include coverage for paragliding (as a high-risk sport) and include medical expenses and emergency repatriation. It is your responsibility to verify your policy provides adequate coverage, as many standard policies exclude these activities. We strongly recommend that all participants obtain personal travel and cancellation insurance that covers weather-related interruptions or cancellations.
This ensures participants are financially protected against circumstances beyond the school’s control.
8. Equipment (Ours & Yours)
Our Gear: All equipment provided by Flying Karlis remains our property. You must handle it with care and follow all instructions. You are financially responsible for the full cost of repair or replacement due to your misuse, neglect, or damage.
Your Own Gear: You must ensure it is certified, airworthy, and recently inspected/repacked. We reserve the right to inspect your gear and prohibit its use if deemed unsafe. We accept no liability for incidents arising from the failure of your personal equipment.
9. Retail, Digital Products & Rentals
Physical Goods
Payment & Shipping: Full payment is required before dispatch. Shipping costs are your responsibility. Risk of loss passes to you upon our delivery to the carrier. Returns: You have a 14-day right to return unused items in their original packaging for a refund. You are responsible for return shipping costs. Warranty: New products are covered by the manufacturer’s warranty. We will help facilitate claims, but the manufacturer’s policies apply.
Digital Products
License: Your purchase grants a limited, non-transferable license for personal, non-commercial use only. You may not share or resell the content. Refunds: By purchasing and accessing digital content, you agree to waive your 14-day right of withdrawal. No refunds are possible once a download has begun.
Equipment Rental
Responsibility: You are fully liable for rented equipment. In case of loss, theft, or damage, you will be charged the full replacement value. Deposit & Late Fees: A security deposit may be required. Late returns will be charged a daily rental fee until the item is returned.
